據美國 SEC 官網，金融部主任 Jim Moloney 表示，SEC 正依據「Project Crypto」計畫訂定加密資產分類指南，並建構判斷其是否構成投資契約的框架；對於被認定為證券的加密資產，該部門正研究建立對應的發行與銷售監理架構。

SEC 表示，將從以執法為主的監理方式，轉向提供更明確的規則指引。

According to the official website of the U.S. SEC, Jim Moloney, Director of the Division of Finance, stated that the SEC is developing crypto asset classification guidelines under its “Project Crypto” initiative, as well as a framework to determine whether such assets constitute investment contracts. For crypto assets deemed to be securities, the division is working to establish a corresponding regulatory structure for their issuance and sale. The SEC added that it will shift its regulatory approach from one focused primarily on enforcement to providing clearer rule-based guidance.
